Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter the "GTC") govern the sales of jewelry, creations, intuitive guidance sessions, and digital products offered on the website L’Eau du Feu.
Any order placed on the site implies full and unreserved acceptance of these GTC by the customer.
1. The seller
The L’Eau du Feu website is operated by:

L’Eau du Feu operates under the VAT franchise scheme (tax-exempt status).
VAT not applicable – Article 293 B of the French General Tax Code.
2. Products
L’Eau du Feu offers jewelry and creations for sale on its website.
Each product is described with its essential characteristics, including materials, dimensions, and finishes.
The photographs on the site are as accurate as possible to the products offered. However, slight variations may occur, particularly due to shooting conditions, lighting, or screen display settings.
3. Prices
Product prices are indicated in euros.
As L’Eau du Feu benefits from the VAT franchise scheme, no VAT is charged to the customer.
The applicable prices are those displayed on the site at the time the order is confirmed.
Any shipping costs are indicated before final validation of the order.
L’Eau du Feu reserves the right to change its prices at any time. Price changes do not apply to orders already confirmed.
4. Ordering
The customer selects the products they wish to order and adds them to their cart.
Before confirming the order, the customer can check its content, the total price, and any shipping costs, and correct any errors.
Confirming the order implies acceptance of these GTC and the obligation to pay.
The order becomes final once payment is confirmed.
A confirmation e-mail is sent to the address provided by the customer.
5. Payment
Payment for the order is made online at the time of confirmation, using the payment methods offered on the site.
Payment is secured by the payment processor used by L’Eau du Feu.
The order is prepared after payment is confirmed.
6. Preparation and shipment
Orders are prepared with care within a maximum period of 7 business days from the date of order confirmation and payment.
Shipments take place twice a week, on Wednesdays and Fridays.
Orders are shipped via Colissimo with signature required upon delivery.
A shipping confirmation e-mail, including a tracking number, is sent to the customer when the carrier collects the package.
Preparation time is distinct from transit time.
7. Delivery
Metropolitan France
Delivery is free for orders over €60 in Metropolitan France.
For any order under €60, shipping costs are indicated before order confirmation.
The estimated transit time is generally around 2 business days after the package is handed over to Colissimo, provided for information purposes.
Europe and International
International orders are shipped via Colissimo.
The estimated transit time is generally between 3 and 15 business days, depending on the destination, provided for information purposes.
International shipping costs are borne by the customer and are indicated before order confirmation.
Any customs duties, taxes, import fees, or other charges applied by the authorities of the destination country are entirely the responsibility of the customer.
L’Eau du Feu cannot be held liable for these costs or any formalities imposed by the destination country's authorities.
The transit times indicated above are for information purposes only. In any event, unless a different timeframe is expressly agreed upon with the customer, the order will be delivered within a maximum period of 30 days from the conclusion of the contract, in accordance with applicable regulations.
8. Receipt of the order
Packages are shipped with signature required upon delivery.
In the absence of the recipient, the delivery or collection methods offered by the carrier will apply.
In the event of a problem regarding the order or damage noted upon receipt, the customer is invited to contact L’Eau du Feu as soon as possible.
9. Right of withdrawal
In accordance with the provisions of the Consumer Code, the consumer has a period of 14 days from receipt of the item to exercise their right of withdrawal, without having to justify their decision.
When the order includes multiple products delivered separately, the period begins upon receipt of the last product.
Customers wishing to exercise their right of withdrawal must inform L’Eau du Feu of their decision before the expiry of this period.
The customer then has an additional period of 14 days to return the product(s) in question.
10. Return conditions
The product must be returned in a condition that allows it to be resold. The customer is responsible for any depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the product.
Any accessories and items supplied with the product must also be returned as far as possible.
The direct costs of return are to be borne by the buyer.
All returns must be made with a tracking number.
The customer must keep the proof of shipment and the tracking number until confirmation of receipt of the return by L’Eau du Feu.
11. Refund
In the event of a valid exercise of the right of withdrawal, L’Eau du Feu will refund the amounts paid by the customer, including the initial standard shipping costs.
If the customer chose a more expensive delivery method than the standard delivery method offered, the corresponding additional cost will not be refunded.
Return costs remain the responsibility of the buyer.
The refund is made without undue delay and at the latest within 14 days from the date on which L’Eau du Feu is informed of the customer’s decision to exercise their right of withdrawal.
L’Eau du Feu may, however, defer the refund until the product is recovered or proof of shipment of the returned product is received, whichever occurs first.
The refund will be made using the same payment method as used for the order, unless the customer expressly agrees to another payment method and provided that the refund does not incur any costs for the customer.
12. Exceptions to the right of withdrawal
In accordance with applicable regulations, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized.
This particularly concerns personalized, modified, or custom-made jewelry, such as bracelets, bangles, or other creations featuring an engraving made specifically according to the word, name, or inscription chosen by the customer, as well as jewelry subject to resizing, transformation, model modification, or addition or removal of elements specifically at the customer’s request.
Once the personalization or modification has been carried out at the customer’s request and the product falls under the exception provided by regulations, the product cannot be subject to withdrawal, return, or refund under the right of withdrawal.
The customer is invited to carefully verify the spelling, dimensions, personalization choices, and content of any inscription provided during the order before validation. L’Eau du Feu cannot be held responsible for a spelling error or incorrect information provided by the customer for personalization.
This exclusion of the right of withdrawal only concerns products actually personalized or modified at the customer’s request. Standard products simply selected and ordered on the site remain subject to the right of withdrawal under the conditions provided for by these General Terms and Conditions of Sale.
This exclusion of the right of withdrawal does not deprive the customer of their rights under the applicable legal guarantees, particularly in the event of a defective or non-compliant product.
13. Intuitive guidance sessions and digital products
L’Eau du Feu may offer personalized intuitive guidance sessions and digital products for sale, such as videos, texts, documents, or other content transmitted in digital format.
These contents are created or prepared specifically for the customer and are provided in digital form after payment confirmation.
When the customer requests immediate access to a guidance session or a digital product before the expiration of the legal withdrawal period, they expressly acknowledge and accept that the execution or provision of the content begins immediately.
In accordance with Article L. 221-28 of the Consumer Code, when legal conditions are met, particularly when the customer has expressly requested immediate execution and acknowledged the loss of their right of withdrawal, the guidance session or digital product can no longer be subject to withdrawal or refund once provided or fully executed.
This provision does not deprive the customer of their rights in the event of failure to provide, non-conformity, or in any other situation where regulations provide a right to a refund.
14. Legal guarantees
Products sold by L’Eau du Feu benefit from the legal guarantees provided for by French regulations.
Legal guarantee of conformity
The consumer benefits from the legal guarantee of conformity under the conditions provided for by the Consumer Code.
In particular, they have a period of two years from the delivery of the goods to act in the event of a lack of conformity.
According to the conditions provided by law, the consumer may request the repair or replacement of the goods. When these solutions are not possible or in other cases provided for by regulation, they may benefit from a price reduction or the cancellation of the contract.
Guarantee against hidden defects
The consumer may also benefit from the legal guarantee against hidden defects provided for in Articles 1641 and following of the Civil Code.
The action resulting from hidden defects must be brought within two years from the discovery of the defect, under the conditions provided by law.
15. Jewelry care
L’Eau du Feu jewelry items are delicate pieces requiring proper care.
In order to preserve their appearance and quality, it is recommended to avoid prolonged contact with water, perfumes, cosmetic products, chemicals, and cleaning agents.
Normal wear and tear related to the use of the jewelry, as well as deterioration resulting from inappropriate use, lack of maintenance, or an accident, do not necessarily constitute a lack of conformity.
Care recommendations provided with the product must be followed.
16. Intellectual property
All elements on the L’Eau du Feu website, including photographs, texts, graphic creations, logos, illustrations, and content, are protected by intellectual property provisions.
Any reproduction, representation, modification, or use, in whole or in part, without prior authorization, is prohibited.
17. Personal data
Personal data collected during an order are used in particular to enable the processing, payment, preparation, and delivery of the order, as well as to ensure customer service.
For more information regarding the collection and processing of personal data, the customer is invited to consult the site’s Privacy Policy.
18. Applicable law
These GTC are subject to French law.
In the event of a dispute with a consumer, they may refer the matter to the competent courts under the conditions provided by applicable regulations.
19. Modification of GTC
L’Eau du Feu reserves the right to modify these General Terms and Conditions of Sale at any time.
The GTC applicable to an order are those accepted by the customer at the time the order is confirmed.
